Data Protection Legal Action against Ms Leslie & CMEC

In June 2021, I brought a Part 8 data protection claim on the grounds that the defendants had failed to comply with their duties under Article 15 of the UK GDPR. In November 2021, The Honourable Mrs Justice Tipples ruled that the case needed to be brought as a Part 7 claim instead of a Part 8 claim.

In December 2021, I duly brought a Part 7 claim and legal exchanges took place in relation to this claim from January to March 2022 when the claim was discontinued.

    The libel claim against Charlotte Leslie & CMEC

    I had issued a libel claim protectively in December 2021, prior to the expiry of the permissible period for such a claim, and Particulars of Claim were subsequently issued in April 2022.

    Ultimately, I was unable to bring the case to full trial, where the facts would have been tested under cross-examination, because Judge Nicklin ruled that the memos had not caused me serious harm. On appeal, the appellate judges held that he had got the law wrong on aggregation and percolation, but they had no discretion to overturn him in his findings of facts.
